Acceptable Use Policy
This Acceptable Use Policy (the "Policy") defines what may not be done with AIBI or with any other Aspen Blue Capital LLC ("Aspen") platform. It forms an integral part of the Platform Terms of Service and applies to every customer, user and agent created on it.
An AI voice agent can call real people, sound human and speak with someone's voice. That capability demands strict limits. If you use the Platform, these limits are your contractual obligation, not a recommendation.
1. General principle
The Platform must be used lawfully, honestly and with respect for the rights of the people contacted. The Customer is solely responsible for deciding who is contacted, when, with what message and with what voice. Aspen does not make those decisions and does not review them in advance.
2. Compliance with contact and telemarketing regulations
Using the Platform to contact people without complying with applicable law is prohibited. In particular:
2.1 United States — TCPA
- You must hold the prior express consent required by the Telephone Consumer Protection Act (TCPA) and its regulations before placing automated calls or sending automated messages.
- The FCC ruled in February 2024 that AI-generated voices are "artificial" voices for TCPA purposes. Calls with AI agents are therefore subject to prior express consent requirements, with the exceptions provided by law.
- You must respect the National Do Not Call Registry and internal suppression lists, and honour do-not-call requests immediately.
- You must respect applicable calling-hour restrictions and caller identification rules.
2.2 Colombia — Law 2300 of 2023
- You must respect the permitted hours for commercial communications and the excluded days set by the rule.
- You must respect a person's right not to be contacted and to request suppression, handling such requests promptly and free of charge.
- You must refrain from repeated or harassing contact.
- You must hold prior express authorisation to process the data, in accordance with Law 1581 of 2012.
In any other jurisdiction, you must comply with the equivalent commercial communications and data protection regulations.
3. Transparency about the agent's artificial nature
- Prohibited: stating or implying that the agent is a human being when the other party asks, or when the law requires disclosure.
- You must disclose that it is an automated system in accordance with the Responsible AI Policy and applicable regulations.
- Prohibited: designing agents whose purpose is to deceive about their artificial nature.
4. Voice, identity and impersonation
- Prohibited: cloning or using a person's voice without their express, informed and verifiable consent.
- Prohibited: impersonating people, officials, authorities, financial institutions, companies or brands.
- Prohibited: generating content that attributes to a person statements they did not make (voice deepfakes) for purposes of deception, defamation, extortion or manipulation.
- Prohibited: falsifying caller identification (caller ID spoofing) or using numbers you have no right to.
5. Fraud, deception and financial harm
Using the Platform for the following is prohibited:
- Scams, phishing, vishing or the deceptive obtaining of credentials, banking details, one-time passcodes (OTP) or personal information.
- Pyramid schemes, false offers, misleading advertising or fake debt collection.
- Abusive collection practices, threats, harassment or undue pressure on debtors.
- Market manipulation or the spread of false financial information.
6. Prohibited content and conduct
- Harassment, threats, intimidation, hate speech or discrimination on protected grounds.
- Sexual content involving minors, exploitation or any illegal content.
- Infringement of third-party intellectual property rights or trade secrets.
- Interference with electoral processes, civic disinformation or impersonation of electoral authorities.
- Coordination of unlawful activity, violence or physical harm.
7. Sensitive decisions and regulated sectors
The Platform must not be the sole basis for decisions with legal or similarly significant effects on a person. In particular, it is prohibited to use it, without qualified human oversight and without complying with sector regulations, for:
- Medical diagnosis, treatment or advice, or handling health emergencies.
- Personalised legal or financial advice, or decisions on credit, insurance or employment.
- Determinations about access to essential services, housing or education.
The Platform is not an emergency service and must not be used to handle or route emergency calls (911, 123 or equivalents).
8. Personal data and sensitive data
- You may only upload personal data for which you have a legal basis and sufficient authorisation.
- Prohibited: uploading sensitive data (health, biometrics, ethnic origin, beliefs, sexual orientation) or children's data without meeting the heightened requirements of applicable law and without having agreed it with Aspen in advance.
- You must comply with call recording regulations: informing and obtaining consent from all parties where the jurisdiction requires it (including all-party consent states in the US).
9. Platform security and integrity
- Do not attempt to gain unauthorised access to other people's accounts, data or infrastructure.
- Do not circumvent usage limits, quotas, security controls or billing mechanisms.
- Do not reverse engineer the service or extract models, weights or system prompts.
- Do not use the Platform to develop a competing product by systematically extracting its outputs.
- Do not deliberately overload the infrastructure or run load tests without prior written authorisation.
- Security testing must go through the Responsible Disclosure Policy.
10. Compliance, sanctions and export control
You may not use the Platform if you are subject to applicable sanctions, nor from embargoed territories, nor for purposes prohibited by United States export control regulations or any other applicable regime.
11. How we enforce this Policy
Aspen does not review agent content in advance and does not routinely listen to conversations. However, we reserve the right to:
- Investigate signs of abuse, third-party complaints, requests from authorities or anomalous patterns (for example, atypical volumes or high complaint rates).
- Request evidence of the consent or legal basis invoked for a campaign.
- Limit, suspend or cancel agents, campaigns, numbers or accounts, immediately where there is legal risk, security risk or risk of harm to third parties.
- Retain and hand over information to competent authorities where the law requires it.
We will endeavour to give prior notice where reasonable and legally possible. In serious or urgent cases the measure may be applied without prior notice. Suspension for breach does not give rise to a refund.
12. Reporting abuse
If you believe a Platform agent contacted you improperly, impersonated an identity or breached this Policy, write to us at business@aspenbluecapital.com with the number that contacted you, the approximate date and time and a description. We investigate every report and may act on the account responsible.
13. Updates
This Policy may be updated to reflect legal changes, new risks or new features. We will publish changes on this page together with their update date.
